    Join us for Coffee with Clinicians, a casual and engaging networking event designed for mental health professionals to connect, share insights, and build community. Hosted by OC CAMFT, this intimate gathering is capped at 20 attendees to encourage meaningful conversations.

    Enjoy a complimentary drink! Each registered attendee will receive a drink voucher, courtesy of OC CAMFT. While walk-ins are welcome if space allows, vouchers are reserved only for those who have registered online in advance—so be sure to secure your spot!

        Law & Ethics: Reducing Liability Risks in a Complex Clinical World: A Helpful Overview of Malpractice and Liability Considerations, Dual Relationships, Soliciting Reviews and Testimonials, and Other Important Topics

        Speaker: Bradley Jordan Muldrow, Esq., CAMFT Staff Attorney

        Target Audience: This course is designed for mental health professionals at an introductory and intermediate level.


        As a CAMFT staff attorney, Bradley J. Muldrow, Esq. takes member phone calls regarding law and ethics issues and contributes articles on those subjects to CAMFT's publication, the Therapist. Prior to joining CAMFT’s legal team, Brad worked on litigation and regulatory matters as an attorney for San Diego Gas & Electric Company. Since becoming an attorney, Brad has given law and ethics presentations to attorneys and judges as a member of the J. Clifford Wallace Inn of Court. He has also served as a board member for the Earl B. Gilliam Bar Foundation, a San Diego-based nonprofit.  

        Course Details

        Brief Summary:

        In our complex world of ever-developing laws and increased caseloads, liability-related fears and concerns can place unnecessary mental and emotional burdens on therapists. Understanding the litigation process and one’s legal and ethical duties can help ease those burdens and allow therapists to practice with confidence and ease. In this six-hour workshop, Bradley Muldrow, Esq. will provide a helpful overview of the malpractice lawsuit process and various types of unprofessional conduct for which therapists may face civil liability, BBS discipline, and/or discipline from the CAMFT ethics committee. The workshop will also address key legal and ethical topics therapists commonly navigate in practice including dual relationships, offering coaching services (in addition to one’s therapy services), and soliciting reviews and testimonials.


        Participants will understand the civil litigation process for malpractice lawsuits. Participants will learn how to recognize and navigate issues involving dual/multiple relationships. Participants will understand key legal and ethical issues therapists should consider when offering coaching services (in addition to their therapy services). Participants will recognize how the ethics code has changed to allow MFTs to solicit testimonials, and impliedly reviews, from certain patients, in appropriate circumstances. Participants will understand the concept of “undue influence” and how that understanding should shape their approaches to soliciting testimonials and reviews. 


        Learning Objectives: 

        Participants will be able to:

        1.  identify at least five types of unprofessional conduct for which the Board can suspend or revoke a therapist's license or take other disciplinary action against practitioners.
        2. Participants will be able to state the stages of the civil litigation process for malpractice lawsuits from the inciting incident (i.e., the incident that led to the lawsuit) to the trial verdict.
        3. Participants will be able to distinguish the primary function of therapy malpractice liability insurance from that of coaching liability insurance.
        4. Participants will be able to state which patients MFTs may solicit testimonials, and impliedly reviews, from in appropriate circumstances
        5. Participants will be able to name three key ethical issues to assess when determining the appropriateness of continuing treatment despite the presence of dual / multiple relationships._________________________________________________
